What do the courts take into account when reviewing a move-away petition?

A parent with physical custody of a child cannot simply relocate without going through the proper steps. A move-away petition must be filed with the courts. When reviewing the move-away petition, the courts will consider:

  • The child’s age
  • The child’s current relationship with each parent
  • How the non-custodial parent’s access to the child will be impacted
  • How the move will affect the child’s emotional stability and well-being
