Initially, the person who files for divorce will pay the court fee. Each party is typically responsible for their own attorney fees. However, if sufficient joint assets are not available and one individual does not earn enough to pay their own legal fees, California Family Code dictates that the court can order the other spouse to cover the legal fees for both parties.
