What happens if my spouse or domestic partner does not agree to a divorce?

In California, both spouses do not need to agree to a divorce. Either party can decide independently to end the marriage or partnership. If your spouse does not want to get divorced and refuses to participate in the proceedings or sign any paperwork, the judge can enter a default judgment and finalize the divorce.
