How does California view prenuptial and postnuptial agreements?

A prenuptial agreement is one made before the marriage, and a postnuptial agreement is one made after marriage. These agreements outline things like property division, spousal support, and other financial matters that clearly outline expectations and responsibilities of each party should they get divorced. For enforceability in California, these agreements must:

  • Be entered into by each party’s free will
  • Have offered sufficient time for each party to review the agreement
  • Have disclosed of all separate property
