In some instances, grandparents can sue for visitation. Some circumstances where grandparents’ visitation rights are more likely to be considered and granted, include if the child’s parents have been separated for six months or are divorced, the child lived with a grandparent for at least a year, a birth parent has died, or the child’s best interests are served when giving the grandparent visitation rights.
