Are You Behind on Child Support?

If you are wondering what to do if you are behind on child support, Kendall Gkikas & Mitchell, LLP is here to help. Keep reading to learn more about child support arrears in California and how Kendall Gkikas & Mitchell, LLP can help you through the process.

What are the different types of child support arrears?

There are two different types of child support arrears – assigned arrears and arrears that are not assigned. Assigned arrears refer to when the custodial parent is living on government assistance. In these instances, child support payments are made to the government directly and if you are behind on child support the government will pursue you itself.

Unassigned arrears refer to when the non-custodial parent owes money to the custodial parent directly. The other parent has a legal right to this money and every missed payment adds up to equal what is called back child support. Interest accrues on this amount at a 10% rate.

What are the options if you cannot pay child support?

If you cannot pay child support, you need to take action right away. You can try to work out an agreement with the custodial parent for a modified payment plan. They can also waive any back amount that is owed to them, but it is important to remember that they do not have to do this as they have a legal right to the money.

If you cannot work with your co-parent, you can also petition the court to have your child support order modified. This can only be done if you can prove that you are not able to pay the amount being requested every month.

What can happen if you do not pay child support?

If you chose not to pay child support, there are a multitude of consequences that can occur. You can have your wages withheld, struggle to get approved for state disability benefits, have unemployment payments garnished, and even have your driver’s license suspended. In addition, a lien can be put on your property, you can be denied a passport, and in some instances, you can also be charged with a crime.
