If You’ve Been the Victim of Domestic Violence in California Then It’s Time You Got HelpIf you’ve been the victim of domestic violence then you need to take action right away. This is a unique crime in that the victim not only needs to work with law enforcement, but it’s wise to work with an attorney as well. At Kendall Gkikas & Mitchell, we have dealt with these cases many times and are here to offer you the support you need.

Domestic violence can come in many forms

It’s common for people who are the victims of domestic violence to believe that the only type of violence that counts is physical violence. The truth is that these cases typically involve verbal, psychological, and / or emotional abuse as well. Depending on the circumstances, the abuser needs to be punished with criminal consequences as well as civil penalties.

Your first step is likely a restraining order

In most cases, your first step is likely to get a restraining order. There are actually three types of restraining orders that can help you:

  1. Emergency Protective Order. This is actually issued by police and is valid for five days after it’s issued.
  2. Temporary Restraining Order. This is issued by a family law court and typically lasts for about three weeks or less and is issued when the issues don’t warrant the involvement of the district attorney.
  3. Permanent Restraining Order. Despite the name, this isn’t actually permanent, though it can last up to five years. In the event it is violated, significant punishments can be doled out, including up to a year in jail.

It’s not just spouses who can apply for a domestic violence restraining order

If you or a minor child has been the victim of any type of abuse, or even the threat of abuse, and the abuser is someone you’re in an intimate relationship with, then you can request a restraining order. This of course includes spouse and domestic partners, but it also includes dating partners, exes, co-parents, and blood or marriage relatives.
